Nearly two years after the government issued a notification sub-classifying backward classes solely on the basis of economic criterion, a vacation Bench of the Punjab and Haryana High Court on Friday put the state on notice on a plea challenging it.
The notice by the Bench of Justice Ajay Tewari and Justice Mahabir Singh Sindhu came on a petition filed by a 17-year-old student from Rohtak, Nisha, through counsel PR Yadav.
Yadav contended that the petitioner qualified NEET-2018 and applied for admission in Haryana.
He added that the petitioner belonged to BC-A category and her rank in merit in the category was around 20. But she could not make it because a notification issued by the state gave first preference to candidates in BC-A category, whose parents’ income was up to Rs 3 lakh.
Describing notification dated August 17, 2016, as “illegal, arbitrary, ultra-vires of the Constitution”, Yadav added it violated Articles 14, 15 and 16 as well as Haryana Backward Classes (Reservation in Services and Admission in Educational Institutions) Act, 2016.
He added the impugned notification was issued under an Act which only provided for “creamy layer” and not for further sub-classification on the basis of income. — TNS
