The Punjab and Haryana High Court on Friday sought the response of Haryana, its Home Secretary, Director General of Police and Director of Haryana Forensic Science Laboratory, Madhuban, on a public interest litigation (PIL) seeking divestment of laboratory’s control from the Police Department and for placing it under the control of the Home Department.
The PIL states the autonomy of the Madhuban laboratory and the ones in Bhondsi (Gurugram) and Sunarian (Rohtak) is maintained.
The PIL also states a core group appointed by the National Human Rights Commission (NHRC) had made recommendations, which were accepted and forwarded to the Union Ministry of Home Affairs, for taking action.
The Home Ministry had then asked state governments to take steps for ensuring independence of forensic labs.
Several states, including Punjab, Himachal Pradesh, Delhi, Rajasthan, Gujarat and Maharashtra, have set up State Forensic Science Development Boards and divested the Police Department of the control of forensic labs.
But in Haryana, the administrative control of forensic labs continues to be with the police.
Levelling allegation against the police for interfering with the functioning of forensic labs, the PIL contends that officials and scientists of the laboratories are not allowed to discharge their functions independently and even the staff is not in a position to send their reports to investigating officer concerned.
