The Punjab and Haryana High Court on Friday ruled that no judicial intervention was required by the special investigating team (SIT) probing the Haryana Civil Services (Judicial) question paper leak case to obtain any record from the High Court administration in relation to the investigation.
A full Bench headed by Justice Rajesh Bindal passed the orders while hearing an application filed by the High Court administration after the SIT asked it to provide some documents needed for investigation.
“In our view, for supply of any documents during the course of investigation, judicial intervention is not required. The HC on the administrative side can decide the same and supply the requisite record for the purpose of fair investigation,” the Bench said.
“Even otherwise, Kanwaljit Singh, senior counsel appearing for the High Court, submitted that the HC had all along been cooperating with the investigating agency. Whatever record was sought was supplied. The court’s intervention is required only if there is any grievance regarding non-supply,” the Bench observed. — TNS
